Managing director: Pat Eckert, hereinafter referred to as the provider, the contract is concluded.
Subject matter of the contract
This contract regulates the sale of new goods from the area of special and unusual waters from all over the world, wine, water tastings and services in the area of water tastings, graphic design, textile design and consulting via the provider's online store. For details of the respective offer, please refer to the product description on the offer page.
Conclusion of contract
The contract is concluded exclusively in electronic business transactions via the store system. The offers presented represent a non-binding invitation to submit an offer through the customer order, which the provider can then accept. The order process for concluding the contract comprises the following steps in the store system:
- Selection of the offer in the desired specification (size, quantity, number, deposit)
- Adding the offer to the shopping cart
- Press the 'Checkout' button
- Enter the billing and delivery address
- Selection of payment method
- Checking and processing the order and all entries
- Click on the button 'Order with obligation to pay'
- Confirmation email that the order has been received
The contract is concluded when the order confirmation is sent.
Contract duration
The contract is concluded for an indefinite period.
Retention of title
The delivered goods remain the property of the supplier until full payment has been made.
Reservations
The provider reserves the right to provide a service of equivalent quality and price. The service shown in the store is exemplary and not the individual, contractual service. The provider reserves the right not to provide the promised service if it is not available.
Prices, shipping costs, return costs
All prices shown for end customers are final prices and include statutory VAT. In addition to the final prices, further costs are incurred depending on the deposit and shipping method, which are displayed before the order is dispatched. If a right of withdrawal exists and is exercised, the customer shall bear the costs of the return shipment.
Terms of payment
The customer only has the following options for payment:
bank transfer, payment service providers (PayPal, direct debit, purchase on account, Visa and Mastercard credit cards, Shopify pay and crypto payment) and cash payment on collection.
Other payment methods are not offered and will be rejected.
The invoice amount must be transferred in advance to the account specified on the invoice, which contains all details for the transfer and is sent by email. The invoice amount shall be collected by the provider by direct debit from the customer's specified account on the basis of the customer's direct debit authorization. If a trustee service/payment service provider is used, this enables the provider and customer to process the payment between themselves. The trustee service/payment service provider forwards the customer's payment to the provider. Further information can be found on the website of the respective trust service/payment service provider. The invoice amount can also be paid in cash at the provider's business premises during normal office hours after deduction of the shipping costs. When paying by credit card, the customer must be the cardholder. The credit card will be charged after the goods have been dispatched. The customer is obliged to pay or transfer the stated amount to the account specified on the invoice within 7 days of receipt of the invoice. Payment is due without deduction from the invoice date. The customer shall only be in default after receiving a reminder. Offsetting against the customer's claims is excluded unless these are undisputed or have been legally established.
2. legal basis for data processing
The legal basis for data processing and for the transfer of data to the above-mentioned third parties is Art. 6 para. 1 lit. b GDPR. In addition, Art. 6 para. 1 lit. f GDPR is the legal basis for data processing.
3. purpose of data processing
The transmission and processing of the data is necessary in order to complete the payment of the transaction you have made on our store portal using the payment method you have selected and thus to complete the transaction.
The connection of many different payment methods is complex and cost-intensive. We therefore use a service provider for the technical connection, which justifies our legitimate interest in the above-mentioned data processing by GiroSolution GmbH in accordance with Art. 6 para. 1 lit. f GDPR.
4. duration of storage
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the above-mentioned data, this is the case when the contract has been completed and there are no longer any claims for rescission, i.e. after expiry of the statutory warranty or guarantee periods. Subject to statutory retention periods beyond this point in time, the data will then be deleted.
5. possibility of objection and removal
The collection of data for the provision of the website and the storage of data in log files is absolutely necessary for the operation of the website. Consequently, the user has no option to object.
Terms of delivery
The goods will be dispatched immediately after confirmed receipt of payment.
We deliver within Germany, as well as the EU, USA, UK and Switzerland.
Shipping takes place on average within 5 days at the latest. The entrepreneur undertakes to deliver on the 21st day after receipt of the order. The standard delivery time is 7 days, unless otherwise stated in the item description. The supplier either ships the order from its own warehouse as soon as the entire order is in stock there or the order is shipped by the manufacturer as soon as the entire order is in stock there. The customer will be informed immediately of any delays. If the supplier is not responsible for a permanent obstacle to delivery, in particular force majeure or non-delivery by its own suppliers, although a corresponding covering transaction was made in good time, the supplier has the right to withdraw from a contract with the customer in this respect. The customer shall be informed immediately and any services received, in particular payments, shall be refunded.
Warranty
Consumers are entitled to a statutory right of liability for defects for the services offered in accordance with the relevant provisions of the German Civil Code (BGB). If there is a deviation from this, the warranty shall be governed by the relevant provisions in the General Terms and Conditions (GTC). The supplier is granted the right to choose between repair or replacement in the event of subsequent performance if the goods are new and the customer is an entrepreneur. If the customer is an entrepreneur, the warranty is excluded for used goods. If the customer is a consumer, the warranty period for used goods is limited to one year. This does not apply to claims for damages by the customer due to injury to life, limb, health or essential contractual obligations which must necessarily be fulfilled in order to achieve the contractual objective. This also does not apply to claims for damages due to grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent. In all other respects, the statutory provisions shall apply.
Contract design
If the customer is an entrepreneur, the risk of accidental loss and/or accidental deterioration of the goods shall pass to the customer upon handover or, in the case of shipment, upon delivery of the goods to the selected service provider. They can do this as follows: If you have made an incorrect entry when ordering in our online store, you can simply cancel your order free of charge by telephone or email.
Right of withdrawal and customer service
Cancellation policy
Right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the date of the order.
In the case of a sales contract: on which you or a third party named by you, who is not the carrier, have taken possession of the last goods. In the case of a contract for several goods which the consumer has ordered as part of a single order and which are delivered separately: on which you or a third party named by you, who is not the carrier, have taken possession of the last goods. In the case of a contract for the delivery of goods in several partial shipments or pieces: on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece. In the case of a contract for the regular delivery of goods over a fixed period of time: on which you or a third party named by you, who is not the carrier, have taken possession of the first goods. If several alternatives coincide, the last point in time shall be decisive.
To exercise your right of withdrawal, you must inform us (FINE LIQUIDS UG (haftungsbeschränkt), Patrick Eckert, Bahnhofstr. 29/1, 74909 Meckesheim, 01781590091 [email protected]) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form , but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to FINE LIQUIDS UG (haftungsbeschränkt), Patrick Eckert, Bahnhofstr. 29/1, 74909 Meckesheim, 01781590091 [email protected] immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Disclaimer
Claims for damages by the customer are excluded, unless otherwise stated below. This also applies to the representative and vicarious agents of the provider if the customer asserts claims for damages against them. Excluded are claims for damages by the customer due to injury to life, limb, health or essential contractual obligations which must necessarily be fulfilled in order to achieve the contractual objective. This also does not apply to claims for damages due to grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent.
Language, place of jurisdiction and applicable law
The contract shall be drawn up in German. The further implementation of the contractual relationship shall be in German. The law of the Federal Republic of Germany shall apply exclusively. For consumers, this shall only apply insofar as no statutory provisions of the country in which the customer has his domicile or habitual residence are restricted thereby. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law is the registered office of the provider.
Data protection
The provider collects, stores and processes data in connection with the initiation, conclusion, processing and reversal of a purchase contract on the basis of these GTC. This is done in accordance with the statutory provisions. The provider shall not pass on any personal data of the customer to third parties unless it is legally obliged to do so or the customer has expressly consented to this in advance. If a third party is used for services in connection with the handling of processing operations, the provisions of the Federal Data Protection Act shall be complied with. The data provided by the customer when placing an order will be processed exclusively for the purpose of contacting the customer within the scope of contract processing and only for the purpose for which the customer has provided the data. The data will only be passed on to the shipping company responsible for delivering the goods in accordance with the order to the extent necessary. The payment data is passed on to the credit institution commissioned with the payment. If the provider is subject to retention periods under commercial or tax law, some data may be stored for up to ten years. During the visit to the provider's Internet store, anonymized data that does not allow any conclusions to be drawn about personal data and is not intended to do so, in particular IP address, date, time, browser type, operating system and pages visited, is logged. At the customer's request, the personal data will be deleted, corrected or blocked in accordance with the statutory provisions. No participation: We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
